  • MDC official bail hearing deferred

    The hearing, which was set to be heard at 9am today, at the High Court was postponed because the state had not filed its response and Justice Hlekani Mwayera could not hear the bail appeal.

    Komichi’s lawyer, Andrew Makoni of Mbidzo, Muchadehama and Makoni legal practitioners confirmed the development and said: “The state had not filed its response on time and the bail application was deferred to tomorrow.”

    Komichi was arrested on July 30 facing charges of contravening Section 85 (1) (e) of the Electoral Act Chapter 2:13, which criminalises taking, destroying or opening a pack of ballot papers without authority.

    Komichi is accused of misrepresenting to the Zimbabwe Electoral Commission that he picked a sealed envelop with a special vote from a dust bin at a Harare hotel.

    Allegations against Komichi are that he marked the ballot papers in favour of the MDC-T since the ballots do not have the secret mark of the presiding officer of the polling station where they are alleged to have been used.

    Last week, Harare magistrate Ms Anita Tshuma threw out his initial freedom bid and remanded him in custody to August 14, when the trial date will be set.
