  • Appeal by MDC members at the Supreme Court postponed
    Movement for Democratic Change (MDC)
    February 01, 2012

Deputy Chief Justice Luke Malaba today postponed an appeal by seven MDC members who were denied bail at the High Court over the false murder charges of the Glen View policeman, Petros Mutedza to 8 February.

Justice Malaba postponed the matter to next week Tuesday citing some family issues that he wanted to sort out.

The MDC members are contesting the findings of the High Court that they are likely to abscond, hide or flee from their homes, saying the ruling was not supported by any evidence or acts.

"The court-a-quo mistook the facts and allowed extraneous or irrelevant matters to guide or affect it. In the circumstances, it is respectfully submitted that the judgment of the court-a-quo was wrong and must be set aside," read the court papers submitted.

Court-a-quo stands for the previous court, which is the High Court.

The seven incarcerated members are; Tungamirai Madzokere, the Councillor for Ward 32, Glen View, Lazarus and Stanford Maengahama, Phineas Nhatarikwa, Stanford Mangwiro, Yvonne Musarurwa and Rebecca Mafukeni.

The appeal by Solomon Madzore, the MDC Youth Assembly chairperson who is detained at Chikurubi Maximum Prison is yet to be heard separately at the Supreme Court.

Another member, Paul Rukanda is yet to appeal for bail at the High Court after he was arrested last week over the same issue and remanded in custody.

The supporters are part of 29 MDC members who were arrested on false charges on murdering the police officer. The other 18 were granted bail at the High Court last year.
