MISA-Zimbabwe
December 19, 2011
High Court judge
Justice Nicholas Mathonsi on 16 December 2011 ordered the release
of Media Monitoring Project of Zimbabwe employees Fadzai December,
Molly Chimhanda and Gilbert Mabusa after he dismissed
an appeal by the state against their granting of bail.
They were remanded
out of custody to 15 January 2012.The trio were granted US$50 bail
each on 9 December 2011 by Gwanda magistrate Douglas Zvenyika. However,
the state invoked Section 121 of the Criminal
Procedure and Evidence Act effectively suspending the granting
of bail.
Background
The trio were
arrested
in connection with a community meeting on public information rights
held on 24 November 2011 in Gwanda. They are being charged under
Section 25 of the Public
Order and Security Act which criminalises the organising of
a gathering without notifying the police as well as section 37 of
the Criminal
Law (Codification and Reform) Act which outlaws distribution
of materials likely to breach peace.
