Magistrate dismisses freelance photojournalist's application for refusal of further remand
MISA-Zimbabwe
March 24, 2009

Harare Magistrate, Memory Chigwaza on 24 March, 2009 dismissed an application for refusal of further remand by freelance photojournalist Shadreck Anderson Manyere.

In her ruling the Magistrate upheld the application by the State to remand the accused to 30 April, 2009 on the grounds that the state needed time to prepare indictment papers for the accused. She, however, cited the need to have the accused indicted by that date.

Manyere who was represented by Alec Muchadehama was challenging his continued placement on remand and the protracted delay in being brought to trial.

The dismissal of the application effectively means that Manyere will remain in remand prison, pending the hearing a Supreme Court application in which he is challenging his continued detention.

Background

Manyere first appeared before the Harare Magistrates Courts on 24 December 2008 together with Zimbabwe Peace Project director Jestina Mukoko.

He went missing whilst in taking his vehicle to a garage in Norton about 40km West of Harare on 13 December 2008.

Manyere made a bail application to the High Court on 19 February 2009 which was dismissed by Justice Yunis Omerjee, but he was granted leave to make an application to the Supreme Court; His case is yet to be heard.

He is charged under section 23 (1), (2) of the Criminal Law (Codification and Reform) Act which criminalises acts of insurgence, banditry, sabotage or terrorism.
