Mirror arbitration case hits snag

An independent
labour tribunal set up to probe the ouster of Dr Ibbo Mandaza from
his Zimbabwe Mirror Newspapers Group (ZMNG) failed to proceed with
the hearings after parties to the dispute failed to agree on the
need for independent arbitration.
The panel led
by retired Chief Justice Anthony Gubbay, had been expected to proceed
with the hearings on 21 November in Harare.
The panel had
been set up after High Court Judge Justice Bharat Patel referred
the matter in which Mandaza is contesting his suspension from the
publishing company to an independent panel led by a retired judge.
However, the
parties reportedly failed to agree as to whether the matter should
proceed by way of arbitration after lengthy consultations on the
circumstances and intentions leading to the order given by the High
Court judge.
ZMNG board chairman
Jonathan Kadzura suspended Mandaza, who is also the Group’s founding
chief executive officer and editor-in-chief on 3 October 2005. The
ZMNG publishes the Daily Mirror and Sunday Mirror.
Mandaza, however,
filed an urgent application to the High Court seeking nullification
of his suspension arguing that the board had no powers to suspend
him as he was the sole owner of the company.
The court referred
the matter to an independent labour tribunal.
Mandaza is arguing
that his suspension was illegal, unprocedural and highly irregular.
