Andrew
Meldrum's acquittal and subsequent deportation order
Trustees of the
Legal Resources Foundation (LRF)
July 16, 2002
The Trustees of the
Legal Resources Foundation warmly welcome the acquittal of Mr Andrew Meldrum
of charges brought against him under the Access to Information and Protection
of Privacy Act. The magistrate's decision is generally correct in law
and is a gratifying example of the independence of some members of the
judiciary at a point in time when this independence is under such severe
attack.
The LRF has always
been of the view that the Act represents a regression towards the suppression
and denial to Zimbabweans of their constitutionally enshrined freedom
of expression. The Act, which has been widely condemned both inside and
outside Zimbabwe, strikes at the heart of press and media freedom, and
runs contrary to internationally accepted norms.
The LRF further expresses
its dismay at the totally unwarranted cancellation of Mr Meldrum's permanent
residence. There is no plausible explanation for the Minister's action,
other than vindictiveness. We understand that the Order was signed several
days in advance of the verdict being handed down and therefore in anticipation
of an adverse verdict in the case.
Mr Meldrum's acquittal
has vindicated him of any wrongdoing and thus there can be no justification
for expelling him from the country. The LRF is of the view that the cancellation
was unlawful, as none of the grounds for cancellation in the Immigration
Regulations can be said to exist.
