HUMAN RIGHTS COMMISSION BILL, 2011
MEMORANDUM
The purpose
of this Bill is to make provision for the powers and operation of
the Zimbabwe Human Rights Commission (“the Commission”).
In more detail the Parts of the Bill provide as follows -
Part I
Clause 1 sets out the Bill’s short title and date of commencement.
Clause 2 contains definitions of terms used throughout the Bill.
Part II
This part provides for the constitution of the Commission. Clause
3 provides for the corporate status, powers and procedures of the
Commission. The appointment of the Deputy Chairperson of the Commission
is provided for in clause 4. The Commission shall employ an Executive
Secretary and staff as provided for in clause 5. The Executive Secretary
shall be subject to the general control of the Commission and he
or she shall be responsible for carrying out the policy decisions
of the Commission and the day-to-day administration and management
of the affairs of the Commission among other responsibilities. The
Commission in clause 8 is required to submit annual reports to Parliament
through the Minister responsible for its administration.
Part III
This Part deals
with investigations that can be made by the Commission. Clause 9
permits the Commission to initiate investigations into matters relating
to human rights. Clause 10 sets the jurisdiction of the Commission
to conduct investigations while clause 12 lays out the manner in
which complaints to the Commission may be made. Clause 14 provides
for the procedure that the Commission must follow after having conducted
an investigation regarding human rights violations.
Part IV
Clause 17 provides
for the funds of the Commission which shall include moneys appropriated
by Act of Parliament and donations and grants from other sources,
subject to the approval of the Minister and the Minister responsible
for Finance. The Commission’s accounts shall be audited and
an internal auditor shall be appointed in terms of Clause 18.
Part V
The immunity
status of the Commission, the Commissioners and staff where they
act in good faith and in pursuance of the Act is provided for by
clause 21. Clause 23 empowers the Commission, with the approval
of the Minister to make regulations for all matters which will be
required or permitted to be prescribed that it considers necessary
for carrying out or giving effect to the Act.

to or connected with the foregoing.
