Electoral
(Amendment of sections 39(2)(b) and 110(3) of Electoral Act) Notice,
2008
IT is hereby
notified that the Zimbabwe Electoral Commission, in terms of section
192(1) as read with section 192(5)(a) of the Electoral
Act [Chapter 2:13], has, with the approval of the Minister of
Justice, Legal and Parliamentary Affairs, made the following notice:-
Title
1. This notice
may be cited as the Electoral (Amendment of sections 39(2)(b) and
110(2) of Electoral Act) Notice, 2008.
Extension
of period within which elections to fill section 39(2)(b) vacancies
must be held
2. Notwithstanding
section 39(2)(b) of the Electoral Act [Chapter 2:13], relating to
the period within which the President must publish a notice in the
Gazette ordering a new election to fill a vacancy in the membership
of Parliament caused by the death of a candidate before the poll,
such period is hereby extended from fourteen (14) days to ninety
(90) days from the date of notification by the Chief Elections Officer
of the death of the candidate in terms of section 50 of the Act.
Extension
of period within which second Presidential election to be held
3. Notwithstanding
section 110(3) of the Electoral Act [Chapter 2:13], following upon
the poll taken on the 29th March, 2008, in each constituency for
the election of a President which resulted in no candidate receiving
a majority of the total number of votes cast, the period within
which a second election to the office of President is to be held
is hereby extended from 21 days to ninety (90) days from the date
of the announcement of the results of the first poll for the election
of a President.
EXPLANATORY
NOTE

note does not form part of the notice, but merely explains its contents)
The extension
of the period under section 2 of this notice is necessitated by
the fact that the Chief Elections Officer notified the deaths of
three candidates who had been duly nominated for the Gwanda South,
Pelandaba-Mpopoma and Redcliff House of Assembly constituencies
in the issue of the Herald dated the 26th March, 2008.
The extension of the period under section 3 of this notice is necessitated
by the fact that it is proposed to run the Presidential run-off
election and the House of Assembly by-elections concurrently at
the earliest possible dates permitted under section 38(1)(b) of
the Electoral Act for the holding of a Parliamentary by-election.
The proposed period exceeds the statutory 21-day period provided
under section 110(3) of the Electoral Act, counting from the day
of the announcement by the Zimbabwe Electoral Commission of the
Presidential election results on the 2nd May, 2008.
This notice
was published as a supplement to the Zimbabwean Government Gazette
Extraordinary dated the 15th May, 2008.
