Financial Adjustments Bill (H.B. 3, 2007)

MEMORANDUM

If a Government Ministry or Department spends money in any financial year in excess of the amount appropriated, or for a purpose for which nothing was appropriated, the Ministry of Finance is required by section 103(5) of the Constitution to cause a Bill condoning the unauthorised expenditure to be presented to Parliament within the next fourteen sitting days of Parliament after the extent of the expenditure has been established.

This Bill will condoned unauthorised expenditure by the Ministry of Home Affairs in the sum of $19 546,27 during the 2000 financial year; by the Ministry of Environment and Tourism in the sum of $554,96 during the 2001 financial year; by the Parliament of Zimbabwe in the sum of $2 641, 42 during the 2001 financial year, $17 899,98 during the 2002 financial year and $3 222 268,19 during the 2004 financial year; by the former Ministry of Lands, Agriculture and Rural Resettlement in the sum of $4 186 331,87 during the 2003 financial year; by the former Ministry of Local Government, Public Works and National Housing in the sum of $1 180 560,92 during the 2004 financial year; by the Ministry of Justice, Legal and Parliamentary Affairs in the of $2 912 323,21 during the 2004 financial year; and the Ministry of Public Service, Labour and Social Welfare in the sum of $3 741 596,92 during the 2004 financial year.

BILL

To condone unauthorised expenditure incurred by the Ministry of Home Affairs, the Ministry of Environment and Tourism, the Parliament of Zimbabwe, the former Ministry of Lands, Agriculture and Rural Resettlement, the former Ministry of Local Government, Public Works and National Housing, the Ministry of Justice, Legal and Parliamentary Affairs and the Ministry of Public Service, Labour and Social Welfare.


ENACTED by the President and the Parliament of Zimbabwe.

1 Short title
This Act may be cited as the Financial Adjustments Act, 2007.

2 Condonation of unauthorised expenditure
The incurring of expenditure which had not been authorised in terms of section 24 of the Audit and Exchequer Act [Chapter 22:03] by—

(a) the Ministry of Home Affairs during the financial year ended on the 31st December, 2000, in an amount of nineteen thousand five hundred and forty-six dollars and twenty-six cents;

(b) the Ministry of Environment and Tourism during the financial year ended on the 31st December, 2001, in an amount of five hundred and fifty-four dollars and ninety-six cents;

(c) the Parliament of Zimbabwe—

(i) during the financial year ended on the 31st December, 2001, in an amount of two thousand six hundred and forty-one dollars and forty-two cents;

(ii) during the financial year ended on the 31st December, 2002, in an amount of seventeen thousand eight hundred and ninety-nine dollars and ninety-eight cents;

(iii) during the financial year ended on the 31st December, 2004, in an amount of three million two hundred and twenty-two thousand two hundred and sixty-eight dollars and nineteen cents;

(d) the former Ministry of Lands, Agriculture and Rural Resettlement during the financial year ended on the 31st December, 2003, in an amount of four million one hundred and eighty-six thousand three hundred and thirty-six dollars and eighty-seven cents;

(e) the former Ministry of Local Government, Public Works and National Housing during the financial year ended on the 31st December, 2004, in an amount of one million one hundred and eighty thousand five hundred and sixty dollars and ninety-two cents;

(f) the Ministry of Justice, Legal and Parliamentary Affairs during the financial year ended on the 31st December, 2004, in an amount of two million nine hundred and twelve thousand three hundred and twenty-three dollars and twenty-one cents;

(g) the Ministry of Public Service, Labour and Social Welfare during the financial year ended on the 31st December, 2004, in an amount of three million seven hundred and forty-one thousand five hundred and ninety-six dollars and ninety-two cents;

is condoned.
