Criminal
Law Code (Standard Scale of Fines) Notice, 2007
THE Minister
of Justice, Legal and Parliamentary Affairs, in terms of section
280 of the Criminal Law (Codification and Reform) Act [Chapter 9:23]
(No. 23 of 2004), hereby makes the following notice:-

1. This notice may be cited as the Criminal Law Code (Standard
Scale of Fines) Notice, 2007.

The First Schedule to the Criminal Law Code is repealed and the
following is substituted—

Explanatory
Note
(This note does
not form part of the notice, but merely explains is contents.)
Section 280(5)
of the Criminal Law Code empowers the Minister of Justice, Legal
and Parliamentary Affairs to publish a statutory instrument setting
forth a standard scale of fines, in the form of levels of fines
(designated by numbers) and the monetary amounts assigned to each
of those levels. In terms of subsection (6) of that section, where
the Minister makes such a statutory instrument, he or she must lay
it before Parliament within the first fourteen sitting days when
it meets after the statutory instrument is made, and the statutory
instrument cannot come into effect unless it is approved by resolution
of Parliament. This statutory instrument, having been approved by
Parliament on the 19th December, 2006, comes into force on the date
of its publication.
Level 3 of the
above scale is the standard level applicable to deposit fines under
section 356 (Payment by accused persons of fines which may be imposed
for minor offences in lieu of appearance in court) of the Criminal
Procedure and Evidence Act [Chapter 9:07]) and other Acts in which
provision for the levying of deposit fines is made. For public information
it is declared that the monetary amount specified for level 3 (as
for the other levels in the Standard Scale) is the maximum amount
that may be levied.
