This Bill will enable
legal force to be given in Zimbabwe to the Agreement for the
Establishment of the African Export-Import Bank, which was concluded
in Abidjan on the 8th May, 1993 and of which Zimbabwe is a signatory.
First Schedule to the Bill deals with the privileges and immunities
to be enjoyed by the Bank. Also
accorded the force of law in Zimbabwe are two other Agreements:-
- the
Branch Office Agreement concerning the location in Harare of
the Bank's first branch office (see the Second Schedule to the
Bill). This Agreement goes into detail about the privileges
and immunities of the Branch and its officials.
- the Memorandum of Understanding concerning the occupancy of
a temporary branch office by the Bank and the transfer to the
Bank of title to a piece of land in George Silundika Avenue,
Harare, for the construction of the permanent branch office
(see the Third Schedule to the Bill).
The
main provisions of the Bill and its First Schedule are similar
to the provisions of existing legislation covering other international
financial institutions - the African Development Bank (Membership
of Zimbabwe) Act, the African Development Fund (Zimbabwe) Act,
and the International Financial Organisations Act (IMF, World
Bank, International Finance Corporation and International Development
Association). Only the Bill's provisions for the Branch Office
have no real counterpart in those Acts.

The purpose of
the Bill is:
1) to establish a National Statistics Agency which will provide
an integrated statistical service system; and
2) to provide for the development and management of official
statistics and the setting up of professional standards and
ethics to be adhered to by organisations that produce statistics
for public information.
The NSA will be a fully-fledged parastatal. The current Census
and Statistics Act, which dates from 1971, will be repealed.
Note: under the existing Act there is a Central Statistical
Office, which is a government department, and the proposed
legislation will transfer the functions, staff, assets, etc.,
of that Office, to the NSA.

| Constitution
of Zimbabwe Amendment (No. 17) Act |
This Act amends
the Constitution to:
- Make
provisions for the confirmation of the acquisition of land
for resettlement which gave effect to the Land Reform Programme
which started in 2000. It provides that these acquisitions
cannot be challenged in court and for the transfer of title
of acquired land to the State. It also provides for the
acquisition in the future of agricultural land for resettlement
and other purposes.
- Reconstitute
Parliament as a bicameral legislature consisting of a House
of Assembly and a Senate. It specifies the numbers for each
house and how they will be elected or appointed. It provides
for the necessary changes to the way that legislation will
be enacted.
- To
include non-discrimination on the grounds of physical disability.
- Include
the institution and functions of the Zimbabwe Electoral
Commission within the Constitution and abolish the Electoral
Supervisory Commission. Voter qualifications will be changed
so that non-citizens who are permanent residents will no
longer have the right to vote.

The
main changes to the Constitution proposed by the Bill:-
- to
shorten the term of office of the President from 6 to 5
years and to make it run concurrently with the life of Parliament
- that
Presidents will generally, as at present, be elected by
registered voters, but that where a President resigns, dies
or is removed from office, a successor to complete the departed
President's term of office will be elected by an electoral
college consisting of the Senate and House of Assembly sitting
jointly
- to
change the composition of the Senate and the House of Assembly
and to make consequential changes to the mandate of the
Delimitation Commission.
- to
make the House of Assembly alone responsible for voting
on motions of no confidence in the Government and resolutions
for the confirmation or extension of states of public emergency
- to
provide for a Deputy Chief Justice
- to
alter the titles of the Commissioner of Police and the Ombudsman
to "Commissioner-General of Police" and "Public Protector"
- to
provide for a Human Rights Commission.
Clarification
It has
been widely assumed that the Bill requires the holding of
combined Presidential and Parliamentary elections in March
2008 when President Mugabe's current six-year term of office
would expire under the present law. That is not so. In fact,
the Bill could even extend his term of office by up to two
years, by allowing him to remain in office until the five-year
term of the present Parliament expires in mid-2010 - unless
he chooses to dissolve Parliament before then.
Clause
2(1) of the Constitutional Amendment (No 18) Bill provides
that an election to the office of President must take place
at the same time as a general election of members of Parliament,
but does not require the holding of an early general election
in 2008. Clause 2(2) of the Bill states that amendments made
by clause 2(1) apply to the President in office on the date
when Amendment 18 comes into effect, notwithstanding the current
section 29 of the Constitution, which states that the presidential
term is limited to six years [the President's current term
will expire on 31st March 2008]. The effect of the Amendment
Bill is, therefore, that President Mugabe's term of office
ends with the next general election, whenever that may be.
A general election must be held in mid-2010, when the current
Parliament's five-year term will end, but will only be held
before then if the President chooses to bring one about by
dissolving Parliament.
So President
Mugabe will not have to face the voters until 2010, unless
he chooses to dissolve Parliament before then. He has said
he would do so in March 2008, but this is a political decision
not dictated by the provisions of the Constitutional Amendment. |

concerns non-statutory crimes. It will re-enact, amend, modify

The
Bill provides for the abolition of the preparatory examination
(under which a criminal trial in the High Court is preceded
by a preparatory examination held before a magistrate to establish
whether there is sufficient evidence to warrant committing
the accused person for trial). That procedure has gradually
fallen into disuse over recent decades; it was last used in
1999. Amendments consequential to that abolition cover:
- aspects
of the procedure for confirmation of extra-curial statements
made by accused persons to investigating officers;
- a new
procedure for early verification before a magistrate of
depositions of witnesses, with a view to the use of those
depositions at the subsequent trial if the deponents are
not then available to testify in the normal way (this will
cater for witnesses who are dangerously ill, expert witnesses
with other professional commitments and any other witnesses
whose attendance at the trial it may not be possible to
secure).
The Bill
also makes provision for:
- a comprehensive
codification and reform of the law on the granting and withholding
of bail; various amendments necessitated by the enactment
of the Criminal Law Code (which will likely be brought into
operation later this year);
- the
admissibility of medical report forms completed by suitably
qualified nurses in respect of the victims of sexual crimes
(at present only medical report forms completed by medical
practitioners are admissible under the relevant provision);
- express
recognition of suitably qualified nurses as competent to
conduct the tests for HIV infection that must be carried
out before sentencing of persons convicted of sexual offences
(testing presently restricted to medical practitioners);
- various
amendments to provisions of the Criminal Law Code - correcting
errors, improving wording in the interests of consistency,
clarity, etc.
- an
extension of the right of audience of legal practitioners
employed by the Zimbabwe Revenue Authority, to permit them
to appear in all courts in civil cases in which ZIMRA is
a party (or in which ZIMRA's Acts are involved) and even,
with the consent of the Attorney-General, in criminal cases
in which ZIMRA has a similar interest.

Bill is to replace the Deposit Protection Board with a new statutory
body to be called the Deposit Protection Corporation, which
will be largely independent of the Reserve Bank. The Corporation's
functions will be similar to those of the existing Board, but
more extensive: the Corporation will have power to obtain information
from financial institutions that will allow it to detect early
signs of difficulties within the financial system; the Corporation
will also be given power to administer failed or failing institutions
and, where possible, restore them to financial health. |

Prevention
of Domestic Violence and Protection of Victims of Domestic
Violence [Draft] Bill, 2003 |
This Bill aims to give victims of domestic
violence the maximum protection from domestic violence that
the law can provide and to introduce measures to ensure that
the relevant organs of the State give full effect to the provisions
of this Bill. The Bill creates a new offence - domestic violence.
It offers a comprehensive definition of domestic violence
which incorporates various degrees of relationships and various
types of abuse. Cultural practices harmful to the girl child
will also be outlawed. It will be mandatory for every police
station to have a section to deal with domestic violence,
and the police are expressly obliged to assist complainants.
The Bill provides for Protection Orders which will ensure
the safety and economic maintenance of the complainant while
the case is being investigated. Application to a magistrate
for a Protection Order can be made outside ordinary court
hours and on any day. A third party will be able to make complaints,
apply for a Protection Order and ensure its enforcement on
behalf of a victim. Making a false charge of domestic violence
is a criminal offence. The Bill provides for appointment of
anti-domestic violence counsellors and for the establishment
of an Anti-Domestic Violence Committee - this can form provincial
and district sub committees, set up safe house etc.

Notwithstanding the
changes to the original Bill and the amendments made by the
House of Assembly and the Senate, the aims of the Bill remain
unchanged. The Bill will amend the Education Act to enable the
Ministry of Education to control fees and levies charged by
non-government schools; but, by virtue of a Committee Stage
amendment the new controls will not apply to "fees and
levies existing on the day the provisions of this Amendment
Act come into effect". It will give the Minister the power
to make regulations for the qualifications of teachers employed
by non-government schools and their conduct and behaviour. The
Minister will also be able to make regulations about the wearing
of school uniforms. The Bill also proposes that all three main
languages will be taught on an equal time basis up to form two.
More than one association of teachers may be recognised.

This
Bill will amend the Electoral
Act [Chapter 2:13], principally to make the following changes
to it: (a)
to incorporate the provisions of the Zimbabwe
Electoral Commission Act [Chapter 2:12] into the Electoral
Act and to repeal the former Act;
(b) to
base the voting process at polling-station level, with voters
obliged to vote at their nearest polling stations rather than
at any polling station within their constituencies;
(c) to
ensure that electronic copies of voters rolls are available
in analysable form;
(d) to
restrict postal voting to voters who are outside the country
on Government business;
(e) to
allow electoral officers and members of the Police Force and
Defence Forces who have to be away from their constituencies
on duty during an election, to cast their votes in advance
of the election at special polling stations established for
the purpose;
(f) to
introduce greater transparency in the counting and collation
of votes at all levels;
(g) to
establish new mechanisms to prevent politically-motivated
violence and intimidation during elections;
(h) to
extend the jurisdiction of the Electoral Court;
(i) to
ensure that the results of presidential elections are announced
speedily; and in addition to correct anomalies and discrepancies
in the Electoral Act. |
