Harare regional
magistrate Kudakwashe Jarabani on 19 March 2012 delivered his judgment
and convicted Munyaradzi Gwisai, anti-debt campaigner Hopewell Gumbo,
director of the Zimbabwe Labour Centre Antonater Choto, student
leader Welcome Zimuto, and social activists Eddson Chakuma and Tatenda
Mombeyarara of violating section 188 as read with section 36 of
the Criminal
Law (Codification and Reform) Act - namely conspiracy
to commit public violence.
Section 188
states in part that 'Any person who enters into an agreement
with one or more other persons for the commission of a crime, whether
in terms of this Code or any other enactment intending by the agreement
to bring about the commission of the crime; or realizing that there
is a real risk or possibility that the agreement may bring about
the commission of the crime; shall be guilty of conspiracy to commit
the crime concerned'.
Section 36 states
in part that 'Any person who, acting in concert with one or
more other persons, forcibly and to a serious extent disturbs the
peace, security or order of the public or any section of the public;
or invades the rights of other people; shall be guilty of public
violence and liable to a fine not exceeding level twelve or imprisonment
for a period not exceeding ten years or both'.
The six ISO
activists are set to appear in court on 20 March 2012 for mitigation
and sentencing. Human rights lawyer and ZLHR member Alec Muchadehama
represented the six activists, whilst Michael Reza appeared for
the state.
Meanwhile in
the High Court the same afternoon, the bail hearings for the 29
Glenview residents before Justice Chinembiri Bhunu in the case of
The State vs. Tungamirai Madzokere, Solomon Madzore and 27 Others
on charges
of murder is set to continue on 21 March at 2:15pm after the
judge postponed the hearing today.
The Supreme
Court is also set to hear the appeal for bail that was filed on
behalf of Solomon Madzore in December 2011 on the same day at 9.00am.
