The 29 Glenview
residents facing trumped up charges
of murdering a police officer, Petros Mutedza at Glenview 3
shopping centre have been indicted.
An indictment is a formal charge or accusation of an offence in
writing against a party. In essence, each accused person was given
a charge sheet, state outline and all the state witnesses'
statement so as to prepare for the trial which commences on the
12th March 2012 at the High Court.
Clarifying the procedures to the accused, most of which have been
out on bail pending trial except for one, Solomon Madzore, the MDC
youth leader, the magistrate indicated that, "in terms of
the law, once a person has been indicted for trial at the High Court
in such circumstances, the bail conditions fall away and the magistrate
court has no jurisdiction to proffer an alternative solution to
sending the accused to prison till his/her liberation either through
a sentence or applying for bail to a higher court.
Among the accused persons is the ZimRights National Programmes Coordinator,
Cynthia Manjoro. She and the bulk of the accused persons were randomly
picked up by the police as being answerable to the murder yet they
were nowhere near the scene of the alleged crime. So far there has
not been any scrap of evidence linking them to the alleged crime.
The Zimbabwe Human Rights Association calls for a finalisation to
this matter. We would like to register our displeasure with bunching
of residents and subsequent stripping of liberties of 29 civilians
for almost a year without making the necessary thorough investigations.
ZimRights is greatly perturbed the police's behaviour of arresting
to investigate rather than the norm which should be investigating
to arrest. The hope now is that there will not be any more delays
as has been the case in the record of this matter. We demand the
release of these civilians.
