High Court frees tormented Mbare residents as judge defers ruling on cop murder suspects

High Court Judge Justice Maria Zimba-Dube on Tuesday 29 November 2011 granted bail to two Mbare residents who were detained in remand prison since their arrest in October for allegedly committing sodomy.

The two Mbare residents, Lionel Girezha (27) and Ngoni Shanya (28) were arrested on 18 October 2011 in Mbare and charged with contravening Section 73 (1) of the Criminal Law (Codification and Reform) Act after they were allegedly caught engaging in a consensual act of sodomy.

They were first denied bail at Mbare Magistrates Court last month forcing their lawyers Advocate Zvikomborero Chadambuka, a member of Zimbabwe Lawyers for Human Rights (ZLHR) and Belinda Chinowawa of ZLHR to approach the High Court appealing against the Magistrate Court's decision to deny them bail.

Justice Zimba-Dube granted the Mbare duo $20 bail which was not opposed by Mr Nyahunzvi of the AG's Office.

The Mbare residents were ordered to report once per week to Matapi Police Station and not to interfere with State witnesses while Girezha was ordered to reside at his given Mbare residence while Shanya should reside in Milton Park suburb.

Meanwhile, High Court Judge Justice Tendai Uchena has deferred his ruling on a preliminary point raised by Edmore Nyazamba of the Attorney General's Office objecting to the appeal filed by lawyers representing seven Glen View residents, who were charged with murdering police Inspector Petros Mutedza in May.
