Councillors
removed from remand as High Court hears Madzore bail application

Harare Magistrate
Don Ndirowei on Monday 17 October 2011 removed from remand two Harare
City Council (HCC) councilors, who were charged with fraud for allegedly
swindling the city council.
Councillor Warship
Dumba and Councillor Casper Takura were arrested on 26 September
2011 and charged with contravening Section 136 of the Criminal
Law (Codification and Reform) Act Chapter 9:23.
Prosecutors
accused Cllr Dumba and Cllr Takura of prejudicing HCC of US$368.94
and a potential prejudice of US$131, monies which they allegedly
claimed to cover transport costs when they travelled to attend Urban
Councils Association of Zimbabwe executive meetings in Bulawayo,
Kariba and Nyanga between May 2010 and December 2010.
However, Magistrate
Ndirowei on Monday 17 October 2011 removed Cllr Dumba and Takura
from remand after their lawyer Gift Mtisi of Musendekwa and Mtisi
Legal Practitioners, who is a member of Zimbabwe Lawyers for Human
Rights applied for refusal of further remand.
Mtisi had argued
in his application, which was opposed by the State prosecutors,
that the facts relied upon for prosecution did not disclose the
commission of an offence of fraud.
Meanwhile, High
Court Judge Justice Hlekani Mwayera will on Tuesday 18 October 2011
preside over the bail hearing of Movement for Democratic Change
Youth Assembly chairperson, Solomon Madzore and Lovemore Taruvinga
Magaya who were arrested on 4 October 2011 and 5 October 2011 respectively
and charged
with murdering police Inspector Petros Mutedza.
Edmore Nyazamba,
a law officer in the Attorney General's Office on Monday 17
October 2011 finally served Madzore and Magaya's lawyer, Mtisi
with his response to the bail application in which he opposed bail.
The bail hearing
had been postponed on almost three occasions, as the State had not
yet filed its response to the bail application.
