conditions

Justice Samuel Kudya on Wednesday 27 July 2011 once again postponed
the bail hearing of eight Harare residents arrested
two months ago on charges
of murdering a policeman to Thursday 28 July 2011.
Justice Kudya
postponed the bail hearing of the eight residents whose lawyers
Tawanda Zhuwarara and Jeremiah Bamu of Zimbabwe Lawyers for Human
Rights (ZLHR) launched a fresh bid for freedom citing changed circumstances
because of the absence of Edmore Nyazamba, a representative of the
Attorney General's Office who could not argue his response
to the bail application.
The postponement
of the bail hearing was the second one inside one week after Nyazamba
on Tuesday 26 July 2011 applied for a postponement to Wednesday
27 July 2011 so as to enable him to file his response to the residents'
bail application.
The eight residents
remained incarcerated at Harare remand prison and Chikurubi prison
after they were denied bail when their co-accused were freed by
High Court Judge Justice Tendai Uchena early this month.
Meanwhile, Justice
Kudya amended the bail conditions for two residents who had been
languishing in remand prison despite being granted bail early this
month by Justice Uchena.
Edwin Muingiri
and Zwelibanzi Dube had been ordered to surrender their travel documents
with the clerk of the Harare Magistrates Court as part of their
bail conditions when in fact they had no such passports. Justice
Kudya granted the application for variation of bail conditions filed
by one of the residents' lawyers Jeremiah Bamu of ZLHR.
