Mangoma's trial resumes

The trial of
Energy and Power Development Minister Hon. Elton Mangoma, who is
charged with allegedly flouting tender procedures in the procurement
of fuel resumed at the High Court on Wednesday 30 March 2011 after
prison officials finally brought the MDC deputy treasurer-general
to court.
The trial, which
commenced on Monday
28 March 2011, was postponed on Tuesday 29 March 2011 after
prison officials failed to bring Hon. Mangoma for trial citing fuel
shortages to transport him to the High Court from Harare Remand
Prison.
During the resumption
of the trial on Wednesday 30 March 2011, Hon. Mangoma's lawyer
Beatrice Mtetwa cross-examined the State's first witness Justin
Mupamhanga, the permanent secretary in the Ministry of Energy and
Power Development, who led evidence on Monday 28 March 2011.
High Court Judge
Justice Chinembiri Bhunu is presiding over the trial in Court A
at the High Court in Harare. Justice Bhunu is being assisted by
assessors Grey Chivanda and Mr Mhandu.
Hon. Mangoma
was arrested
on Friday 25 March 2011 and charged with criminal abuse of duty
as a public officer as defined in Section 174 (1) (a) as read with
Section 174 (2) of the Criminal
Law (Codification and Reform) Act Chapter 9:23.
The State represented
by Chris Mutangadura, a chief law officer in the Attorney General's
Office alleges that Hon. Mangoma unlawfully and intentionally abused
his public office for the purpose of showing disfavor to some local
and South African companies, which had participated in a tender
for the supply and delivery of prepayment revenue management system
meters and associated equipment.
Prosecutors
say Hon. Mangoma unlawfully instructed ZESA Holdings board chairman
Dr Noah Madziva, former ZESA Holdings chief executive officer Benjamin
Rafemoyo and the State Procurement Board to stop processing the
tender for the supply of prepaid electricity meters after adjudication
thereby effectively cancelling a tender awaiting announcement of
the winner.
