The bail application
for our comrades resumed today with our comrades being represented
as usual by Alec Muchadehama and the state represented by the prosecutor
one Edmore Nyazamba. The presiding officer is Justice Samual Kudya.
The hearing of the application
for bail is underway with the state opposing and saying that the
Applicants are not the proper candidates for the granting of bail
on the grounds that they have a lot of connections out of the country,
they may continue with their plan of removing the government. Further
the state is alleging that treason is a very serious offence that
the accused when granted bail may abscond trial.
It is also alleged on
behalf of the state that they also want to make further extra-territorial
investigations into the matter. Further that the accused may interfere
with witnesses and evidence in the matter.
Mr Muchadehama is however
opposed to the allegations and insist that no crime was committed
and that the accused were in custody for long since February 19,
almost a month now so the state was supposed to have finished its
investigations. Mr Muchadehama proposed a bail amount of US$1 000.00
for each of the accused and reporting to police twice a week and
to reside at given places of residence.
the state is however
opposed to this and they want the accused to remain in custody and
not to be granted bail at all.
We are afraid that the
bail if granted, the sum will be too high judging from the previous
case which was decided by the same judge Kudya in which Elton Mangoma
was ordered to pay US$5 000.00 for a lesser serious case than treason.
In the meantime the court
has adjourned and will resume for the ruling at 15:15hrs today.
Those who can manage to attend please do so in solidarity with the
comrades.
Further those who want
to send financial assistance for the purposes of the bail you may
do so, we will greatly appreciate that.
Judging from
the facts presented so far in the matter, it is highly likely that
bail will be granted but the state has shown (from its behavoiur)
that even if bail is granted it will appeal against it.

Urgent
appeal for US$12,000 bail: Gwisai & 5 others bail granted
We are happy to announce
to you that the bail application for our comrades was granted this
afternoon.
The sum to be deposited
with the clerk of the court as bail sum is US$2 000.00 for each
person. Of the six therefore the total will be $12,000.
The other conditions
are that the comrades reside at specified addresses, surrender passports
and travelling documents, not to interfere with the evidence and
to report on Mondays, Wednesdays and Fridays to the CID Law and
Order Harare
Our appeal now is that
we do not have sufficient funds to secure the release of the comrades
if any one is willing to assist please let us know as soon as possible
in order for us to secure the liberty of our comrades.
