Residents granted bail in assault case
Zimbabwe Lawyers for Human Rights (ZLHR)

Harare Magistrate Moses Murendo on Tuesday 8 February 2011 granted bail to four residents of Rugare suburb in Harare, who were arrested last week on assault charges.

Magistrate Murendo ordered Kudakwashe Ngorima, Wiseman Murwira, Rabson Mudhinhwa and Faresi Mapiki, who were arrested on Friday 4 February 2011 and charged with assaulting Andrew Shambo, a ZANU PF youth member, to deposit $50 with the clerk of court and to report once a week at Harare Central Police Station's CID Law and Order Section.

The four residents, who were granted bail following an application, which was filed by their lawyer, Gift Mtisi of Musendekwa-Mtisi Legal Practitioners, who is a member of Zimbabwe Lawyers for Human Rights (ZLHR) were ordered not to interfere with State witnesses and to continue residing at their given residential addresses.

Ngorima, Murwira, Mudhinhwa and Mapiki were remanded out of custody to 24 March 2011.

State prosecutor Memory Chiweshe alleged that the residents assaulted Shambo on 2 February 2011 at a ZANU PF District Office located at Rugare Community Hall in Rugare with open palms, an iron bar, wooden sticks and pebbles with the intention of causing bodily harm, a charge which the residents deny.

Chiweshe said Shambo sustained injuries on his back-bone as a result of the alleged assault. But Shambo, who claimed to have sought medical examination at Kambuzuma Clinic, failed to table a medical affidavit in court as an exhibit.
