  • Politics meddles in Constitution Draft
    Zimbabwe Human Rights Association (ZimRights)
    January 18, 2011

The constitution data uploading process which started in Monday 17 January, came to a standstill as the Welshman Ncube led MDC formation withdrew from the process demanding the replacement of four rapporteurs and a personal assistant to Co-Chairperson Edward Mkhosi, who broke from the party ahead of the national congress held this year. The five refused to be relieved of their duties saying they would only do so when all the three constitution co-chairpersons have shown consent of the move through their signatures.

Although Hon. Edward Mkhosi (MDC-M) and Hon. Paul Mangwana (ZANU PF) had signed the replacement letters, Hon. Douglas Mwonzera (MDC-T) refused to sign the letter arguing that the select committee had agreed that no replacement would be made to the data compilations staff from the 5th of January, and MDC-M made the requests after the management committee met later in the day and agreed to let MDC-M make its changes provided they pay the replacements and indemnified COPAC from any legal action.

The demand for representation in the constitution drafting process is a clear sign of the politicisation of the constitutional making process, hence raises some controversy to the authenticity of the 'people driven process'. As long as the process continues to be governed by equal political party representation, its outcomes will inevitably be a negotiated document by the three political parties. ZimRights calls for COPAC to ensure that the objectivity of the process is not compromised by political party demands. The constitution draft must be a true reflection of what the people of Zimbabwe want and not what the three political parties want.
