Later in the
evening of 23 March, Okay Machisa was released, and ZimRights filed
an urgent application to the High Court demanding the return of
the photographs.
Late the afternoon
of 24 March, High Court Judge Kudya granted ZimRights their application,
and ordered that the police return the photographs. According to
Zimbabwe
Lawyers for Human Rights, in the judgement Justice Kudya held
that it was clear that the police seized the photographs without
the consent of the possessors (ZimRights) and had no legal power
to do so under any known law.
Around 6pm -
with the event scheduled to begin at 5:30 - the photographs
were returned, and were again hung for display.
