The
trial in which the Election Resource Centre (ERC), is
being charged on allegations of contravening Section 40 C of
the Electoral
Act, has today been postponed to the 28th of October 2013. The
ERC represented by the Director, Tawanda Chimhini and 3 others (Farai
Saungweme, Moses Chikora and Wadzanayi Nyakudya) briefly appeared
before a Harare Magistrate at Rotten Row courts this morning. The
trial could not kick off as the state submitted to the court that
it was overwhelmed with other cases at hand. The state subsequently
asked for a postponement, which was accordingly granted by the court.
Meanwhile the defence team, represented by Trust Maanda of the Zimbabwe
Lawyers for Human Rights (ZLHR) notified the court of its intention
to apply for referral to the Constitutional Court challenging the
constitutionality of the section being used to charge the accused
persons. The Defence team felt that some provisions of the Section
violated the accused person's freedom of expression. The Election
Resource Centre shall update you in due course the proceedings on
the application to the Constitutional Court.
