judgement for Bulawayo student leaders as Magistrate fails to turn
up

Five Bulawayo
student leaders appeared in a Bulawayo magistrate court yesterday
for the determination of their case. The five Sheunesu Nyoni (ZINASU
Treasurer),Samson Nxumalo (NUST Student Union Secretary General),
Melusi Hlabano (former Bulawayo Polytechnic SRC Information and
Publicity Officer), Archiford Mudzengi ( former School of Mines
SRC President) and Brian Mtisi (former NUST SRC Information and
Publicity Secretary are facing charges of participating in an illegal
demonstration. The charges arose from a demonstration which took
place on the 11th of November 2008 which was organized by the National
Constitutional Assembly (NCA), demanding a new constitution
just before the formalization of the Government of National Unity
(GNU).
The five students
who had appeared in court on Wednesday 20th of May 2009 when the
state and the defence counsel gave their final submissions and judgement
was reserved for the 27 of May. The prosecutor argued that students
violated the Public
Order and Security Act (POSA) intentionally and as such should
face the consequences of their actions. The students were represented
by Ms Nqobile Ndlovu from the Zimbabwe
Lawyers for Human Rights (ZLHR).
Yesterday the magistrate
failed to turn up so as to hand over judgement on the case. The
prosecutor had to postpone the judgement to 10 June.
