Bail appeal for Okay Machisa postponed
Crisis

January 22, 2013
The High Court
bail appeal hearing for Okay Machisa, the incarcerated
ZimRights
director and Crisis in Zimbabwe chairperson has been once again
postponed and will take place on January 24, 2013.
The postponement
was once again owing to the lack of preparedness by the Attorney
General's Office. It emerged that a new set of prosecutors
Nyazamba and Chingarande have been assigned to the case after previous
prosecutor, Nyahunzvi, failed to turn up at the High Court on Monday,
January 21. Nyazamba said Nyahunzvi was attending a workshop which
prompted the AG's office to reassign the case to them.
The two prosecutors
said they had not received copies of the appeal, but Beatrice Mtetwa,
who led the defence team, said she had submitted the appeal for
bail at the AG's Office on 09:40hrs on January 17 and the
Criminal registry before the court sat.
Nyazamba replied,
saying him and his colleague, Chingarande, had not seen the copies
as Nyahunzvi had locked them up in his office and asked that the
matter be postponed to January 25. They also cited the fact that
the state would want more time to study the appeal. After Mtetwa
argued that the matter be instead postponed to January 23, the judge
settled for January 24.
