The Zimbabwe
Civil Society Kimberly Process Local Focal Point (KP-LFP) would
like to clarify some misconception that has been circulated in recent
media reports.
Firstly the
St Petersburg Agreement stipulates that the KP Local Focal Point,
with suitable qualifications representing civil society, shall be
appointed by the KP Civil Society Coalition in consultation with
the KP Working Group on Monitoring. Contrary to some media reports,
the St Petersburg agreement does not state that the appointment
of the LFP will be done in consultation with Government.
Secondly, contrary to media assertions, the representatives
of the Civil Society in the Kimberly Process Review Mission team
that visited Zimbabwe in August 2010 did not agree with the proposition
by the Permanent Secretary in the Ministry of Mines that the government
will decide how the Local Focal Point will be appointed as that
was going to be contrary to the letter and spirit of the St Petersburg
Agreement.
Under the auspices
of the National Association of Non-Government Organisations (NANGO),
six civil society organizations, with knowledge of the events in
Marange and expertise on the Kimberly Process came together to form
a Technical Committee of the Local Focal Point; this acts as the
Local Focal Point and has all the powers vested in the Local Focal
Point by the WGM as agreed in the St Petersburg agreement. The members
of the technical committee are Centre
for Research and Development (CRD), Zimbabwe
Environmental Law Association (ZELA), Zimbabwe
Lawyers for Human Rights (ZLHR), Women's
Coalition, Counselling
Services Unit (CSU) and Crisis
in Zimbabwe Coalition. NANGO acts as the secretariat. Each member
of the Local Focal Point is mandated with monitoring a particular
aspect of the Joint Work Plan and produces reports that will be
discussed by the group and presented to the KP Monitor or to the
Working Group on Monitoring. The report to the KP Monitor or the
Working Group on Monitoring is done by a Coordinator chosen from
amongst members of the Technical Committee. Therefore, the Local
Focal Point is not an individual or Mr. Shamiso Mtisi as stated
in reports by the "CSO Coalition". Mr. Mtisi is just
the Co-ordinator or a liason person, all the powers to make decisions
lie with the Technical Committee/Local Focal Point. It is a mechanism
composed of seasoned researchers with knowledge and expertise on
the Kimberly Process and the situation in Marange.
