  • Maguwu's high court ruling expected
    Crisis in Zimbabwe Coalition
    July 09, 2010

The bail ruling of the Centre for Research and Development Director Farai Maguwu has been deferred to Monday 12 July 2010 at 11.30 am after High Court Judge Mawanze Gurainesu cited that he needed more time to go through the submissions by the state and the defense counsel.

The state prosecutor Marevanhema submitted that Maguwu should remain in custody until investigations have been completed. Marevanhema said that if Maguwu is granted bail there is great chance that he might abscond and may interfere with investigations. The state further noted that it required another month to complete investigations.

The defense lawyer Ms Beatrice Mutetwa argued that the state is continuously denying Maguwu liberty on the same basis that the investigations are not complete. This is despite the fact that the state has not submitted any evidence to show that there are investigations being done. She added that the lack of evidence before the court is a clear testimony that the state is dragging its feet in dealing with the matter. Ms. Mutetwa urged the court not to continuously tolerate the state's postponement of the dates and should seriously consider the basis of granting bail so that Maguwu's right to liberty is respected.

Maguwu has been in custody for thirty-six days and is facing charges of allegedly communicating and publishing falsehoods in contravention of Section 31 of the Criminal Law (Codification and Reform) Act. Maguwu's High Court bail hearing was postponed on Wednesday 07 July after Gurainesu postponed the hearing citing that he had a tight schedule. The bail application hearing continues on Monday the 12th of July at the High Court of Zimbabwe, in Harare.
