  • State drags feet on Maguwu case
    Crisis in Zimbabwe Coalition
    June 16, 2010

The state has continued dragging its feet in the case of arrested Centre for Research and Development (CRD) Director, Mr. Farai Maguwu by further seeking postponement of Maguwu's bail hearing.

Speaking before High Court Judge, Justice Chinembiri Bhunu, prosecutor; Mr. Chikosha said that the State needs more time to research and respond to the bail appeal lodged by the defense following Maguwu's denial of bail by Harare Magistrate, Donald d Ndirowei on the 10th of June 2010. Chikosha sought postponement of the hearing on Friday 18 June 2010 citing that the defense had not submitted a record of proceedings for the 10 June appearance at Rotten Row Magistrates Court.

The defense led by Ms. Beatrice Mtetwa however argued that the records could be obtained from Rotten Row Magistrates court accusing the state of deliberately delaying the hearing. 'This has become a norm rather than exception. The state believes that postponements are merely there for the taking without putting any facts before the courts,' said Ms Mtetwa.

Mtetwa quizzed the state on why Maguwu had not accessed medical treatment almost one week after the Magistrate court ordered Prison Services to take him to a professional medical practitioner. Chikosha told the court theta he was not aware of the reasons behind the failure by Prisons to comply with the order. He told the court that he would conduct an investigation and report back to the courts.

Justice Bhunu said that the state should respond to the failure by Prisons to comply with the order at 2:30pm today. He further noted that judgment on whether the hearing should be postponed or not will be delivered at the same time.
