Further
update on advice to individuals receiving a response from the Constituency
Registrar relating to "Finalisation of electoral appeals to
objections issued in terms of section 25 of the Electoral Act [Chapter
2:01]"
Zimbabwe Lawyers for Human Rights (ZLHR)
February 27, 2003
It has come
to our attention that several individuals who submitted letters
to the Constituency Registrar in terms of our previous advice under
category 4 (Zimbabwean citizens who renounced their Zimbabwean citizenship,
and were issued with a permanent resident stamp in their foreign
passport upon renunciation in 2001/2002) have received responses
thereto.
We suggest that
the following letter be written in response, after which no further
correspondence should be entertained, until such time as the Supreme
Court appeal has been finalized.
"I confirm
receipt of your letter dated ___________ in reference to the above
matter. I do not intend to continue corresponding back and forth
about these issues. Suffice to say that I deny your allegations
as listed in points 1 to 5 of your aforementioned letter and maintain
that I remain on the voters’ roll, entitled to vote, until such
time as the Supreme Court has ruled in the appeal of Case No.
SC 104/2002, as the relevant issues have not been fully addressed
and adjudicated by the court.
I reserve
my rights accordingly."
The letter should
bear the words "WITHOUT PREJUDICE" at the top.
This information
is provided in the public interest and as a public service by Zimbabwe
Lawyers for Human Rights. It should not be considered to be legal
advice, and we urge individuals who have further queries to consult
a legal practitioner as soon as possible.
