Chairperson's court case thrown away

The National
Constitutional Assembly (NCA) Chairperson Professor Lovemore
Madhuku today appeared at the Harare's Magistrate courts on charges
of a case he is alleged to have committed in 2004 and 2006.
On the 2nd of
March 2011 Professor Madhuku was served with 2 summons to appear
in court on allegations of contravening Section 24 (1) of the Public
Order and Security Act (POSA) [Chapter 9:15], in that he allegedly
failed to comply with a police order given to disperse NCA members
who were demonstrating in Harare demanding for a democratic people
driven constitution.
The defense council led
by fearless lawyer Alec Muchadehama argued that the submissions
by the state were a divergence from the initial charge as per the
summons. Today the state had a new charge alleging that Professor
Madhuku illegally organized a demonstration which had initially
been barred by the regulating authority.
The Magistrate dismissed
the case noting irregularities on the submissions by the prosecuting
team.
Professor Madhuku
was served with the summons whilst attending the case
of the 45 jailed ISO
activists at the Harare Magistrate courts on the 1st of March 2011.
The state initially claim
that the NCA leader unlawful organized and participated in an unauthorized
demonstration on the 4th of March and the second charge is for alleged
failure to abide by orders of the regulating authority during an
NCA organized demonstration on the 1st of November 2006 at Africa
Unity Square.
As the NCA we welcome
the ruling by the Magistrate and today's verdict is a clear indication
that the NCA leader has no case to answer.
Hundreds of activists
attended today's court session in solidarity with the revered constitutional
law expert.
